Russian judge fired after falling asleep in court

(AP) ? A Russian judge has been fired after he caught 40 winks in court and then sentenced an outraged defendant to five years in prison.

Judge Yevgeny Makhno of Blagoveshchensk City Court in Russia's Far East was forced to resign Friday for obviously falling asleep several times while trying a businessman on charges of fraud.

The case became a national scandal after the defendant's lawyer posted several videos online of Makhno asleep in court. The videos were then shown on state television.

Makhno claimed that he was not sleeping, but listening with his eyes closed, the reports said.

But since a higher court decided not to punish him, Makhno only has to take an exam to be reinstated.

The defendant, however, will be given a new trial.

Joe Benavidez and Demian Maia take UFC 156 decisions

Demian Maia and Joe Benavidez started UFC 156's main card with decision wins on Saturday night.

In the battle of the wrestler vs. the grappler, grappling whiz Demian Maia easily won over wrestler Jon Fitch.

Fitch, who wrestled collegiately at Purdue, could not stop Maia's takedowns. Throughout all three rounds, Maia took Fitch's back, and controlled him from there throughout. The one saving grace for Fitch was that he could stop Maia's submissions, but Fitch offered no offense. The judges saw it 30-27 on every card for Maia.

Maia has found welterweight to be a much more welcoming weight class. He has three wins there, over Fitch, Rick Story and Dong Hyun Kim. Fitch, on the other hand, has hit a rough patch. He is 1-2-1 in his last four fights.

Joe Benavidez won over Ian McCall to start off the main card. Benavidez had the better of McCall early on, wobbling him early in the first round, but McCall's grappling kept Benavidez at bay in the second round. Benavidez stopped McCall's takedown attempts and wobbled him early in the third round. The judges saw it 29-28 across the board for Benavidez.

Both fighters lost their last bouts to the flyweight champ, Demetrious Johnson. Getting the win at UFC 156 was key for each fighter to get another shot at the belt. Benavidez's win puts him to 17-3, with his last two losses coming in title fights.

Automated breast density test identifies women at high cancer risk

Feb. 1, 2013 ? Researchers at Moffitt Cancer Center and colleagues at the Mayo Clinic in Rochester, Minn., have developed a novel computer algorithm to easily quantify a major risk factor for breast cancer based on analysis of a screening mammogram. Increased levels of mammographic breast density have been shown in multiple studies to be correlated with elevated risk of breast cancer, but the approach to quantifying it has been limited to the laboratory setting where measurement requires highly skilled technicians. This new discovery opens the door for translation to the clinic where it can be used to identify high-risk women for tailored treatment.

"We recently developed an automated method to estimate mammographic breast density that assesses the variation in grayscale values in mammograms," explained study lead author J. Heine, Ph.D., associate member of the Cancer Epidemiology Program and Cancer Imaging and Metabolism Department at Moffitt.

According to the authors, mammographic breast density, or the proportion of fibroglandular tissue pictured on the mammogram, is an established risk factor for breast cancer. Women with high mammographic breast density have a greater risk of developing breast cancer. However, mammographic breast density has not been used in clinical settings for risk assessments due in large part to the lack of an automated and standardized measurement.

Using their new method, the researchers compared the accuracy and reliability of their measurements of variation in breast density with the performance of tests that use the degree of dense breast tissue in a mammogram to assess breast cancer risk. A study describing their novel method and its utility was published in a recent issue of the Journal of the National Cancer Institute.

According to Heine, they found that the variation measure was a "viable, automated mammographic density measure that is consistent across film and digital imaging platforms" and "may be useful in the clinical setting for risk assessment."

In addition, they found that the association between variation and the risk of breast cancer was strong for mammograms carried out four years prior to diagnosis. The automated method also made clearer distinctions between breast cancer case subjects and controls who did not have breast cancer.

While many clinicians use the risk predictive value of percent of breast density seen on the mammogram as the amount or proportion of bright tissue in an image, Heine and his co-authors found the variation of dense tissue is also relevant to breast cancer, suggesting a relationship between percent of breast density and variation in breast density.

"The strengths of this study include the evaluation and validation of a novel breast density measure across three well-designed epidemiological studies," said study co-author Thomas A. Sellers, Ph.D., M.P.H., center director of Moffitt. "Because we were able to compare this novel breast density measure with an established percent density measure that was available four years before diagnosis, we were allowed to show that variation was present for at least four years, and in some cases, more than eight years. Offering clinicians and patients the advantage of more timely, reliable and accurate risk could open the door for interventions to lower risk and, hopefully, prevent the disease from occurring."

The researchers concluded that the simplicity of the measure, and the ability to standardize and automate the measure across sites, could hold promise for clinicians and their patients if the measurements were incorporated into clinical risk assessment practices.

Where are the surprises in Super Bowl ads?

With the growth of social media sites like Facebook and Twitter, it's no surprise that more advertisers are releasing ads online up to a week or more before Game Day.

The majority of the 30-plus Super Bowl advertisers have been releasing their spots in the days leading up to the game. So it's unlikely there'll be lots of action off the football field to make viewers drop their jaws on Sunday.

Advertising fans already can catch a glimpse of "Spider-Man" actor Willem Dafoe in a Mercedes-Benz ad. They can watch a baby Clydesdale grow up in an Anheuser-Busch commercial. They even can spot old people partying in a Taco Bell ad.

Gone are the days when Super Bowl spots were closely-guarded secrets. With the growth of social media sites like Facebook and Twitter, it's no surprise that more advertisers are releasing ads online up to a week or more before Game Day.

In recent years, more advertisers have been making their spots public before the Big Game. This year, 26 of the 35 or so advertisers have released their spots, with more reveals expected, according to YouTube.com.

Companies have good reason for doing this. Last year, Super Bowl ads released early were watched 600 percent more times ? with 9.1 million average views ? than ones released after the game, according to YouTube.com, which hosts advertisers' commercials on its site.

"The conversation has gone from Monday morning around the water cooler to social media, so basically what that means is there's no downside in showing your cards early and getting people to talk about it and starting up some buzz," said Charlie Warzel, staff writer at Adweek Magazine.

Still, Warzel said not everyone likes seeing ads early. "There are a lot of people who want to be surprised and can't help but see these things floating around the Internet or picked up by news agencies. So the element of surprise is taken away."

To be sure, a few companies are betting that there's still cachet in making the "big reveal." The few advertisers that are staying mum this year are hoping they can accomplish what Chrysler did last year ? its two-minute halftime spot featuring Clint Eastwood was so unexpected that it was one of the most memorable ads of the game.

"Last year, Chrysler shocked everyone with a Clint Eastwood ad no one knew about," said Barbara Lippert, a columnist at mediapost.com. "This year, no one knows what Chrysler is doing."

Besides Chrysler, companies that haven't revealed their spots yet include Mondelez' Oreo and Research In Motion's BlackBerry. All the companies have so far declined to discuss their plans for Super Bowl publicly.

"Oreo has developed this ad for the Super Bowl and, as such, it's only fitting that it debuts during the Super Bowl," according to an Oreo statement.

That hasn't stopped ad experts from speculating. "Oreo's advertising might really hit the mark because people are tired of sex and beer," Lippert, the columnist, said. "Blackberry's commercial is coming from a British agency so I have high hopes for it."

Procter & Gamble's Tide also hasn't released its ad, but it has given some details. For instance, the company said that the ad will include both teams in the Super Bowl ? the San Francisco 49ers and Baltimore Ravens ? and discuss stains that might be worth keeping.

"We feel that the magic of the ad would be lost if we revealed it before its slot in the game," said Chris Lillich, the company's associate marketing director.

There might also be some surprises from advertisers that have already released ads. Experts say some companies may tinker with their plans.

Something to watch for, Lippert said: Whether Volkswagen changes its Game Day spot that features a Minnesotan man with a Jamaican accent, which faced some criticism in the days leading up to the Super Bowl from some people who deemed it culturally insensitive.

"There might be some surprises and last-minute changes," Lippert said.

APNewsBreak: Feds: Warming imperils wolverines

BILLINGS, Mont. (AP) ? The tenacious wolverine, a snow-loving carnivore sometimes called the "mountain devil," could soon join the list of species threatened by climate change ? a dubious distinction putting it in the ranks of the polar bear and several other animals the government says will lose crucial habitat as temperatures rise.

Federal wildlife officials Friday proposed Endangered Species Act protections for the wolverine in the Lower 48 states. That's a step twice denied under the Bush administration, then delayed in 2010 when the Obama administration said other imperiled species had priority.

It likely means an end to trapping the animals for their fur outside Alaska.

But federal officials said they won't use the animal's status as a means to regulate greenhouse gases blamed in climate change. And other human activities ? from snowmobiling and ski resorts to timber harvest and ? would not be curtailed because they do not appear to be significant threats to wolverines, officials said.

There are an estimated 250 to 300 wolverines in the contiguous U.S., clustered in small, isolated groups primarily in the Northern Rockies of Montana, Idaho, Wyoming and Washington. Larger populations persist in Alaska and Canada.

Maxing out at 40 pounds and tough enough to stand up to grizzly bears, the animals will be no match for anticipated declines in deep mountain snows female wolverines need to establish dens and raise their young, scientists said.

In some areas, such as central Idaho, suitable habitat could disappear entirely, officials said.

Yet because those losses could take decades to unfold, federal wildlife officials said there's still time to bolster the population, including by reintroducing them to the high mountains of Colorado.

"This is a species there is still time to do something about," said Mike Thabault, ecological services director for the U.S. Fish and Wildlife Service's mountain-prairie region.

Wildlife advocates, who sued to force the government to act on the issue, said the animal's plight should be used by the Obama administration to leverage tighter restrictions on greenhouse gas emissions.

As with the polar bear, the government is sidestepping that thorny proposition with the wolverine, and said in Friday's proposal that listing the animal as threatened "will not regulate greenhouse gas emissions."

Thabault said the agency would be on tenuous scientific grounds if it tried to draw a link between specific emission sources and impacts on wolverines.

Advocates expressed disappointment, with Noah Greenwald from the Center for Biological Diversity saying the administration "should not be exempting greenhouse gas emissions from the Endangered Species Act."

A Washington, D.C., attorney, John Martin, who represented the energy industry during litigation over polar bears, said he expects no change in the administration's policy against using endangered wildlife to regulate emissions.

Friday's proposal also allows Colorado's wildlife agency to reintroduce an experimental population of wolverines that eventually could spill into neighboring portions of New Mexico and Wyoming.

It would shut down wolverine trapping in Montana, the only one of the Lower 48 states where the practice is still allowed an annual quota of five animals.

This year's trapping season was blocked by a state court order, but Montana officials hoped to restore trapping next year.

Montana Fish Wildlife and Parks spokesman Ron Aasheim said the state will review the federal proposal and had not settled on a response.

Once found throughout the Rocky Mountains and in California's Sierra Nevada mountain range, wolverines were wiped out across most of the U.S. by the 1930s due to unregulated trapping and poisoning campaigns, said Bob Inman, a wolverine researcher with the Wildlife Conservation Society.

In the decades since, they have largely recovered in the Northern Rockies but not in other parts of their historical range.

While reintroducing the animals further south might seem counterintuitive, Inman said Colorado's abundance of 14,000-foot mountains would make it well suited as a refuge for the animals as warmer temperatures set in at lower elevations.

Only one wolverine currently inhabits the state, a male that wandered down several years ago from northern Wyoming's Teton Range, about 500 miles away. Inman said Colorado has enough high-mountain territory to support up to 100 more of the animals.

"That's like a 30 percent increase in their population size," he said.

Any reintroduction into Colorado would require approval from state wildlife commissioners and the Legislature, Colorado Parks and Wildlife spokesman Randy Hampton said.

Representatives of the state's ski and agriculture industries in the past have raised concerns that bringing wolverines back could hurt their industries. Hampton said no decision has been made and it could take years to work out all the details.

Other areas where wolverines once roamed also could serve as future refuges.

Those include portions of Utah, Oregon's Cascade Range, Wyoming's Big Horn Mountains and the Sierra Nevada, said Shawn Sartorius, a biologist with the Fish and Wildlife Service based in Montana.
