Romney Imitates Needle in Haystack With Ford Field Speech

Everyone was amused throughout the Internets today by Mitt Romney holding a speech for 1,200 people inside Ford Field in Detroit, leading to images of a cavernous, empty stadium. And it?s completely puzzling WHY Romney?s advance team would site a speech like this in a big, empty stadium, just waiting for the snickering comments. Heck, for a shockingly small price, Romney?s team could have bought the Pontiac Silverdome and just painted faces on all the seats and piped in some crowd noise.

This is just fall-on-your-face political campaigning. And Romney didn?t help matters with his ad-libs.

?This feels good, being back in Michigan,? Romney said. ?You know, the trees are the right height. The streets are just right. I like the fact that most of the cars I see are Detroit-made automobiles. I drive a Mustang and a Chevy pick-up truck. Ann drives a couple of Cadillacs, actually. And I used to have a Dodge truck. So I used to have all three covered.?

Who among us doesn?t have a couple of Cadillacs to drive? To be fair, when you have an indeterminate number of houses, you have to stash vehicles all over the place.

Snickering aside, the content of the speech should cause horror more than laughter:

The outline of Romney?s tax reform plan is the same as what you heard on Wednesday. And Romney backed his advisers up, promising that his plan ?will not add to the deficit.? Or he appeared to. But the way it won?t add to the deficit, he said, was through ?stronger economic growth, spending cuts, and base broadening will offset the reductions.? Raise your hand if you see what Romney did there [...] For those keeping score at home, that suggests that independent analyses will find that the tax plan is revenue negative. Big time [...]

Romney?s real savings come in the next section. He?ll ?send Medicaid back to the states and cap that program?s rate of growth,? and then ?do the same for other programs, like food stamps, housing subsidies and job training.?

Sending the programs back to the states is a red herring. The key bit for deficit reduction is capping their rates of growth. Which is to say, cutting their rates of growth. Which is to say, cutting them.

What Romney is essentially proposing to do is finance a massive tax cut by cutting Medicaid, food stamps, housing subsidies and job training. In other words, the neediest Americans ? and, to a lesser degree, federal workers ? will be financing a massive tax cut.

Maybe I should have just stuck to the laughing and pointing at the crowd size.

On a bright note for Romney, this cruel swipe at the poor to finance tax cuts that go mostly to the rich should be enough to secure him the Republican nomination.

'Milkshake murderer' Kissel seeks fresh appeal

HONG KONG -- An American woman convicted twice in Hong Kong of drugging her wealthy banker husband with a laced strawberry milkshake and bashing him to death wants to appeal her latest conviction.

The South China Morning Post newspaper, which requires readers to register, reported Friday that Nancy Kissel had applied for permission to appeal her conviction last year for the murder of Robert Kissel.


Kissel's lawyer previously said she was not going to appeal, but that she planned to ask to serve her sentence in the U.S., the AFP news agency reported.

However, a court spokeswoman confirmed to AFP Friday that Kissel, originally from Adrian, Mich., had recently sought permission to appeal her conviction.

Nancy Kissel, an American woman living in Hong Kong, was convicted of killing her investment banker husband by poisoning his milkshake. After winning an appeal, a second trial recently ended with another guilty verdict for Kissel, who insists she was a battered wife who acted in self-defense. TODAY's Jenna Wolfe speaks with Frank Shea, a key witness in the case, and criminal defense attorney Paul Callan.

"No date has been set for the hearing," a court spokeswoman told AFP.

'Adultery, violence, spying, greed'
Kissel's first trial in 2003 grabbed world headlines as it detailed the disintegration of the wealthy expatriate couple's marriage in the southern Chinese financial center.

AFP said the case had shone "a spotlight on Hong Kong's elite expatriate community, and featuring sensational allegations of a heady mix of adultery, violence, spying, greed and enormous wealth."

In March last year, a jury found her guilty at a retrial. She had denied murder, but admitted the lesser charge of manslaughter for causing his death.

She had testified her husband physically and sexually abused her.

Kissel must apply for permission to appeal because the 28-day deadline to file one following the trial in March has passed.

Robert Kissel's older?brother, Andrew, was also murdered. He was found stabbed to death in 2006 in his Greenwich, Connecticut, mansion at the age of 46, three days before he was going to plead guilty in federal court to real estate fraud. His estranged wife, Hayley Wolff Kissel,?did not attend the funeral.

Andrew and Rob Kissel shared more than blood. They each had the trappings of success; nice homes; wealth; luxury lifestyles. Who would want to kill either man, let alone both of them?

His death remains a mystery, although there has been speculation he planned his own murder, sacrificing himself so his family could?benefit from his?insurance policies.

Mancini: Tevez could play for Man City in 2 weeks

MANCHESTER, England (AP) -Carlos Tevez could be back in action and spearheading Manchester City's challenge for the English Premier League in as little as two weeks.

City manager Roberto Mancini says he has accepted Tevez's apology for his conduct since refusing to warm up during September's Champions League match against Bayern Munich and is prepared to restore the Argentina striker to his team.

Mancini says "he maybe needs two or three weeks to find good form and after, if he is OK, he will play."

Mancini added that he will meet Thursday with the 28-year-old Tevez, who has recently returned from an unauthorized three-month break in South America.

The London Stock exchange has been actively growing its data business and they have experienced almost 25% growth in the area just last quarter. This recent deal with Google is the first of its kind at the exchange, but it is not exclusive and there is nothing to bar them from creating similar promotions with others.

BP Cherry Point Fire: Washington Crews Fight Flames At State's Largest Oil Refinery

FERNDALE, Wash. (AP) ? Fire crews doused a dramatic blaze that broke out Friday at Washington's largest oil refinery, sending up towering flames and creating a thick plume of black smoke visible for miles.

Workers at the BP Cherry Point refinery near Blaine in northwest Washington's Whatcom County were evacuated shortly after the fire started at about 2:30 p.m. in a tower on the refinery's south side. The fire was out by 4 p.m., BP spokesman Scott Dean said.

The Bellingham Herald reported that about 100 evacuated workers gathered in a parking lot to watch the flames.

All employees and contractors who were at the site were safe and accounted for, Dean said, although he could not provide a precise figure Friday night. One contractor complained of knee pain and went to a local hospital for observation, the spokesman said.

Dean couldn't say what the tower is normally used for or what it contained.

Television footage showed fire crews sending several streams of water onto the fire and also using retardant foam to douse the tower.

There was no immediate word on the cause of the fire or the extent of damage.

The refinery continues to produce products for customers, Dean said, adding it was "too soon to speculate on future supply impacts."

The one-square-mile refinery employs more than 800 people and can process as much as 230,000 barrels of crude oil a day from Alaska. From that amount, the refinery has the ability to produce 2.5 million gallons of jet fuel, 3.5 million gallons of gasoline, 2.2 million gallons of diesel, 360,000 gallons of butane and 140,000 gallons of propane.

According to the BP website, the refinery is the largest supplier of fuel for the Seattle, Portland, and Vancouver, British Columbia, airports. It also provides 20 percent of Washington state's gasoline, the website said.

The refinery was fined more than $69,000 in 2010 for 13 serious safety violations, state Department of Labor and Industries spokesman Hector Castro said. He added that all five of the state's refineries have been fined for safety regulations.

Inspectors were heading to Cherry Point to investigate Friday's fire.

The U.S. Environmental Protection Agency was sending an air-monitoring crew to make sure there was no danger to those nearby, EPA spokesman Mike MacIntyre said.

Mike Abendhoff, another BP spokesman, said the refinery's own air-monitoring crew had already begun tests and he had no reports of danger from fumes.

Queer Chick, I would appreciate some sage advice. Or at least a moment of your thyme.

I have been in a relationship with a wonderful woman for the past six years. She's a few years older than me, and while I'm not her first girlfriend, she's mine. I'm also what you'd call a gold star, despite classifying myself as bisexual (we both do. In Kinsean terms, I'm about a 2-3, she's about a 4-5). I got into this relationship when I was just out of my teens, in my final year of college. We moved in together relatively quickly (I know, clich?) and things got serious almost immediately.

We have a lot in common, can talk easily and at length about almost everything, we laugh together, support each other, and have both become part of each other's families. It's a pretty darn solid relationship. The problem here lies in the bedroom. We have a great sex life for the most part, however more and more I have found myself fantasizing about people other than my girlfriend when she's fucking me. "So what?" I hear you say, "Everyone fantasizes" ? the thing is, they're fantasies about men, oftentimes two men together. And sometimes I can't even climax without thinking about it. Having never had the experience of being with a man before getting into this relationship, I have become increasingly heterocurious, wishing I could turn back time and fuck a few good men (maybe not Tom Cruise though) so I at least knew what it was like, and wouldn't be driven crazy by thoughts of it. It's not just the D, either (though that is certainly a factor), as I know I could take the sextoy route to explore that in a way. It's being with a man, the whole man (and nothing but the man? So help me god).

I don't want to cheat on my girlfriend, nor do I want to break her heart by leaving her to satisfy some morbid curiosity, and I know for sure the open relationship/threesome route is a no-go, certainly not this far along in our monogamy. I love this woman, but as things are progressing further and further toward talk of marriage and babies and whatnot, I know I could not in good conscience agree to be with her for the rest of my life unless I knew that's what my heart/vagina really wanted. I can't talk to my friends about this, because I'm afraid if I do they won't support me in this relationship anymore, thinking I'll never be truly happy. I don't know how to talk to my girlfriend about it without crushing her and risking her feeling inadequate/lacking for the rest of our life together.

That is brutal, and scary. And I don't want to minimize its impact for anyone currently struggling with it.

But I also want to say, since so many people seem to be dealing with this lately (perhaps because we're all more aware of and comfortable with bisexuality than our counterparts 25 or even ten years ago), that I think when you get right down to the secret squishy heart of this issue, it is actually terribly simple. You have to decide whether, by staying with your lover, you're gaining more than you're giving up.

You, lovely Letter Writer (may I call you Lettie?), are coming at this from a slightly different angle than I normally hear about; you are already bi-identified, instead of a nominally straight chick who is suddenly lusting after ladies. That is going to potentially make this a teeny tiny bit easier for you to navigate, because you won't have to deal with quite so much ?holy shit what will people think when they find out?? Still, the basic issue is the same. You don't have to re-label and reorganize your sexual identity, but you have to make some big, potentially gut-wrenching decisions.

First of all, I want to put your hot boy-on-boy brain-porn off to one side while we talk about this, because it's not really the salient point here. You're right that everyone fantasizes, and some people can only (ever!) climax when they're focusing on their favorite fantasy scenario, but the Thing that turns you on the most when you're allllllllmost there is not necessarily the Thing you actually want in real life. It could be relevant, if you're wishing you were in the middle of a sweaty dude-sandwich instead of in bed with your girlfriend, but on its own it doesn't tell us much.

What's more important is that you're thinking about dudes even when you're not in the zone, and it's causing you to question whether you want to marry your lady. So this is where I suggest, as I always do, that what you really have to ponder is not ?how badly do I want to get some wang?? but ?how committed am I to my partner?? Long-term monogamy is not for the faint of heart, but for the right person, you should be able to make the sacrifice gladly ? I don't mean easily, I mean with joy even when it's difficult. Look, Lettie, real talk: sometimes I wish I had slutted it up a little more before I got together with my fiancee. Sometimes I regret my lack of crazy random hook-up stories, just like you regret the lack of penis in your past. But I know that the person I'm with now is the person I want to be with for the rest of my life, and that is worth giving up on every other possibility to focus on this one, this one that is right.

There is this terrifying and hurtful myth that, when you meet the perfect partner, The One, your super special soulmate who likes to cook your favorite food and can find your G-spot blindfolded, you will immediately and forever stop wanting to have sex with other people. This is not even remotely true, but it causes an insane number of problems by convincing you that the moment you get an itch in your panties for somebody new, your relationship is doomed. In reality, the only thing that dooms your relationship is when you decide that she's not the one for you ? that you don't love her enough to make all the rest of it, from not fucking boys to picking up her dirty socks when she leaves them on the floor, worthwhile. Being bisexual, though it adds another dimension to the wanting-to-have-sex-with-other-people dilemma, does not ? or at least should not ? make much of a difference in the outcome.

So this is the part where you have to make the tough choice, and by now you've probably noticed that I have not said one single goddamn thing that will help you with that process, because there's really nothing I can say. Everything hinges on the part that I don't know and can't tell you, which is: do you want to be with this woman forever? And are you willing to do what it takes to make that happen?

Just so we're clear, it's okay if the answer is ?no.? I'm not saying that you are a bad or weak person if you decide that you need to pack up your things. I won't be mad if it turns out that she's not the one for you, or you're not the one for her, or you're both too young to be making lifelong relationship choices, or whatever. Choosing the path that will make you happiest, and sticking to it even when it means hurting someone you care about, because you know it's better for you both in the long run, requires tremendous self-honesty as well as ovaries of steel. If that's what you have to do, I'm sorry, and my heart is with you. Things will get easier from here, and you're going to do fine.

But if you decide to stay with your lover ? if you throw yourself into this relationship with your whole heart/vagina and stick to it for the long haul ? then perhaps I can offer you some words of wisdom that will help you through the rough patches: seriously, dudes are not all that great.

I have a sister-in-law (my husband's brother's wife) who I love to pieces. She is the sister I never had. We are two soldiers in the neverending fight against our mother-in-law. Everything is love, happiness, sunshine, except ... her mother is a lesbian who lives with her long-term girlfriend. Still, you ask, where is the problem?

SIL has mentioned in passing a couple times that she believes this "sets a bad example" for my niece and nephew, because, you know, homosexuality is ?bad.? Her husband agrees. In these few instances, I have felt deeply uncomfortable with her comments, especially when she says these things in front of her children (one of whom is in high school, so we're not dealing with babies here). Despite my disapproval, I think her relationship with her mother is none of my damn business, right? She has not asked me for advice or come to me with concerns. She seems to think this is common sense and that I must agree with her.

Also, my brother-in-law is somewhat volatile and is easily offended or angered. I would hate to cause a rift between my husband (totally pro-LGBTQ, by the way) and his considerably more conservative brother on behalf of a woman I've never met. (If, for example, one of my future kids turned out to be LGBTQ of any sort, I'd cut a bitch who dared say that kind of thing at a family gathering. Though I'm sure that's easy for me to say from this safe, privileged, hypothetical distance. Does that make me a hypocrite?)

Her kids do spend time with SIL's mother, but I know it's with the understanding that her "lifestyle" is "bad." I am tempted to pull my niece aside and tell her that there is nothing wrong with homosexuality, but again, is that totally inappropriate and not at all my place? Is it inappropriate to NOT say anything? She?s a smart kid, but I don?t want to put her in an awkward position. Do I wait until she's an adult? Do I continue to keep my mouth shut? Do I say something just to my SIL? Do I passive-aggressively mention every gay or lesbian friend I have at any opportunity to imply that I'm not on board the Anti-Gay Express? I am naturally non-confrontational, so the prospect of a big family argument scares the bejeezus out of me.

Help me, a Queer Chick! What is the right thing to do?

Ugh, there is such a huge part of me that wants to be like ?stop being friends with your awful homophobic sister-in-law.? It's really weird to me when people talk about how such-and-such person is great and wonderful and sweet and awesome and oh there's just this tiny problem where they haven't even met me but they already hate me. I don't want to hear about how she makes the best vegan cupcakes and gets all your most obscure Buffy references; if she hates the gays, then she is Not Cool and should not be invited to your birthday party.

Okay, but I recognize that I'm being unreasonable. People are flawed and messed up, and having one terrible character trait does not necessarily cancel out all the virtues that make you enjoy someone's company. I myself probably have at least one friend who is some kind of intensely crazy bigot in a way that I don't even know about because it's never come up. If you're not the target of the irrational disgust, it can be awfully easy to overlook for the sake of preserving your friendship. Plus, even if you did tell her to take her homophobia and shove it, she'd still be married to your husband's brother, so it's not like you could avoid her forever. And it's probably better for your niece and nephew if their parents remain on speaking terms with their awesome, queer-friendly aunt and uncle. ESPECIALLY if one of them turns out to be queer, because that shit is going to be rough, but even if they're straight it would be nice for them to have at least one familial influence who is not a great big juicebox.

So what's a non-confrontational chick to do? Well, no matter how much you love your sister-in-law and fear conflict, I think you are doing yourself and your niece and nephew (as well as your hypothetical future queer offspring) a disservice if you let her slide completely. I'm not saying you should throw your iced coffee in her face the next time she makes a disparaging comment about her mother (although you totally can, I'm not gonna judge), but you need to let her know that on this issue, she does not have a sympathetic ear from you.

When she mentions her mother in a way that makes it clear she disapproves of lesbians en masse, I want you to remain perfectly calm and say, in the most neutral tone of voice you possess, ?I don't know about that. My friend Julie is gay, and she's awesome.? (Feel free to name an actual person, if you do not have a gay friend named Julie.) Then ? this is key ? change the subject immediately. You are not trying to start a fight; you are not trying to win her over; you are simply letting her know, politely but firmly, where you stand. If she tries to pursue the subject, just laugh it off ? ?I don't feel like arguing on such a nice day! Want to take the kids to the park??

You may have to do this more than once before it sinks in, but I doubt you'll have to do it more than two or three times. Again, since your priority is maintaining a positive relationship with your sister-in-law, you have to resist the urge to press the point, to tell her about all the awesome queers in your life, to make a compelling case for human rights and social justice and RuPaul and fisting. I guarantee you that if her own mother couldn't bring her around, you're not gonna be able to do it either, and the more you try the more you'll damage your friendship. All you can do is continue to make it clear that you love her, you respect her, but on this topic you'll have to agree to disagree.

I am a 27-year-old queer lady. My best friend is an ex-girlfriend. We dated for several years and were engaged at one point. After the initial post-breakup awkwardness, we remained friends. We live in separate states but email near-daily and visit one another a couple times a year. We've each dated since the breakup and don't have any residual feelings for each other. Our relationship is essentially the same as any other best friend pair, except that we used to date. I never really thought this was weirder than anything else humans do, but lately I've heard people say some things (including in a former column of yours!) that make me wonder if I missed the consensus statement issued by the Strategies of Lesbianism Convention wherein it was decided that girls who are friends with ex-girlfriends are automatically off-limits creepers?

Do I have to choose between my best friend and any hope of a successful future love life? Is it a major turn-off to learn that a woman is best friends with someone she used to bone? Is there a way I need to be telling people about this that makes me sound less creepy? Is it inappropriate that I address holiday cards, etc. to my friend and her girlfriend? Please help me, A Queer Chick!

As much as it's clear to me that you folks would like one, there is no one-size-fits-all strategy for dealing with The Dreaded Ex-Turned-Bestie. Sometimes those friendships are creepy and codependent; sometimes they are positive and nurturing; and only you (or the women you date) can say for sure. If your friend is not constantly reminiscing about your relationship and bringing up how much she misses you ? if you're upward of 90% confident that you two have no lingering sexual tension ? then it's probably fine, rock on with your sweet selves.

The Ex-Turned-Bestie is really only a problem if it's interfering with your current relationships, and it sounds like you've both been getting laid left and right since your breakup, so I don't see why you'd be worrying about this. If a future girlfriend ever does express concerns, you'll have to figure out for yourself whether it's really a problem or whether she's just above-average insecure, and proceed accordingly. For the time being, however, why fix something that's not broken (or a domesticated animal which you want to prevent from reproducing)? I feel like you mostly wrote to me because you wanted an affirmation, which I am more than happy to provide (to anyone! Holler atcha girl if you need to be reminded that you are a beautiful special snowflake!), but yeah, you don't really have much of a problem here. Your friendship is 100% Queer Chick approved ? go forth and rejoice!

UVA Lacrosse Murder Trial: George Huguely Defense Says Yeardley Love Died By Accident


Former University of Virginia lacrosse teammates of George Huguely V testified against him as the prosecution wrapped its case in his murder trial this week.

Meanwhile, the defense brought its first witness, a doctor who said Yeardley Love, his fellow lacrosse player ex, died of suffocation, not blunt force trauma.

Jan Leestma, a neuropathologist, contradicted the prosecution's medical witnesses, saying he saw swelling on Love's brain but no sign of blunt force trauma.

"I could not conclude it is trauma," he said. Instead, he suggested, she suffocated on a bloody pillow. The lack of oxygen to her brain likely caused the swelling, he claimed.

Moreover, the rush of blood during resuscitation attempts caused the bruising.

The prosecution argues that George Huguely murdered Yeardley Love in a May 2010 incident in which he shook her violently until her head banged a wall.

The defense says it was a tragic accident, and that Huguely's actions did not directly kill Love, his on-and-off girlfriend at the University of Virginia.

One of the final witnesses for the prosecution, Ken Clausen, a former lacrosse teammate of Huguely's, testified Wednesday that Huguely had lied about where he had been when he returned home from Love's apartment the night in question.

Clausen said that George Huguely's demeanor had changed and that he was so drunk he wasn't making any sense, Thursday's Today show reports.

Clausen said Huguely, now 24, claimed he had been downstairs in an apartment with two other teammates. But Clausen later discovered that wasn't true.

Other teammates also testified that Huguely had been drinking heavily all day, and that he had a blank stare on his face when he returned that night.

Researchers have developed the first 'newborn weight curves' for specific ethnic groups across Canad

TORONTO, Ont. -- One of the first things people ask new parents is how much does their baby weigh.

For some immigrant parents, especially South Asians, the question may be stressful. Many of their newborns are incorrectly diagnosed as being significantly underweight, meaning they could be at higher risk of developmental issues.

Researchers at St. Michael's Hospital say many of these infants are in fact the correct birthweight for their ethnic group and should not be compared to those of babies of Canadian-born mothers.

The researchers, led by Dr. Joel Ray, have developed the first "newborn weight curves" for specific ethnic groups across Canada. Birthweight curves are graphs used to plot how one baby's weight compares to others of the same age. A baby whose birthweight is in the lowest tenth percentile of the curve is deemed to be "small for gestational age" (SGA).

The new curves and his related research were published today in the Journal of Obstetrics and Gynaecology Canada.

Dr. Ray examined 760,000 live births in Ontario, which has 55 per cent of Canada's immigrants. He found that babies born to mothers from each region of the world, except Europe and other Western countries, had significantly lower birthweights up to 250 grams less -- than those for infants of Canadian-born mothers.

He found that 67 of every 1,000 babies born to parents from Africa or the Caribbean were at risk of being classified as significantly underweight if plotted on an outdated Canadian curve instead of the new world region-specific curve.

Even more troublesome was his finding that 116 of every 1,000 South Asian babies more than one in 10 -- were at risk of being misclassified under the Canadian curve.

"That's unacceptable in my mind," said Dr. Ray. "There are all these parents who are very excited about having a baby, and now they might have concerns their baby is not big enoughsomething that it not true and not especially welcoming."

Dr. Ray also examined how many babies were being incorrectly labeled as too heavy, or in the ninetieth percentile in birthweight. When correctly diagnosed, these babies may need to be delivered early; thus, a misdiagnosis may result in unnecessary elective cesarean sections.

The current Canadian curve misses as many as six in 10 Southeast Asian/Pacific and South Asian babies who are big compared to others in their ethnic groups.

Birthweight is important not just for parents' peace of mind. It is also one of the essential yardsticks used to measure a baby's progress or failure to thrive in its first days and weeks.

"Our findings have potential impact in several ways," Dr. Ray said. "The number of new immigrant parents and infants affected is sizable, meaning that there is a large target group in need of new birthweight curves."

Secondly, recent immigrants may not understand the implications of having a significantly underweight infant and may lack the linguistic, social, financial or transportation resources to effectively follow-up with pediatric care.

"By implementing our modified birthweight charts, a large number of newborns will be spared an unnecessarily prolonged stay in hospital, special biochemical and genetic testing, and follow-up with a general or developmental pediatrician," Dr. Ray said. "This lowers the burden on not only the child and their parent, but also on limited in-hospital and pediatric clinic resources within the ever-busy GTA. "

Apple may face iPad export ban in China trademark dispute

A Chinese tech firm that says it owns the iPad trademark, plans to seek a ban on exports of Apple Inc?s computer tablets from China, a lawyer for the company said.If successful, the move could deal a blow to the U.S. technology giant?s iPad sales worldwide. Not only is China a huge consumer market but it is a major production base for the American company?s iconic products including the iPad, iPhone and iPod.

The Chinese firm Proview Technology (Shenzhen) Co Ltd is petitioning Chinese customs to stop shipments of Apple?s popular

iPads in and out of China, though the customs have not responded to its request, lawyer Xie Xianghui told Asian Legal Business, a Thomson Reuters publication.

Customs officials could not be reached for comment and Proview declined to comment.

Apple?s legal tussle with Proview Technology (Shenzhen) over the trademark name iPad, is emerging as the latest headache for the U.S. giant in a booming market and highlights the legal challenges facing foreign multinationals operating in China.

Apple lost a case to Proview Technology (Shenzhen) in a Shenzhen court in southern China late last year when the court agreed that Proview owned the iPad trademark.

Apple has appealed the decision and a final hearing is due to start in the southern Guangdong High Court on Feb 29. This court?s decision will be final under the Chinese legal process.

Proview?s latest salvo comes a day after media reports that authorities in some Chinese cities had ordered retailers to stop selling Apple?s iPad due to the dispute.

Apple said it had bought the worldwide rights to the trademark long ago.

?We bought Proview?s worldwide rights to the iPad trademark in 10 different countries several years ago. Proview refuses to honor their agreement with Apple in China and a Hong Kong court has sided with Apple in this matter,? an Apple spokeswoman said.

Proview Technology (Shenzhen) has asked authorities in about 20 cities, including Shijiazhuang near Beijing, to stop retailers from selling the popular iPad tablet PC and has also filed lawsuits against Apple in Shanghai and Shenzhen, and retailers selling iPads in Futian and Huizhou, located in the south of the country.

Apple?s options are limited to either settling with Proview Technology (Shenzhen), appealing to a higher court or facing devastating enforcement actions in China, legal experts said.

?There are two views we can take here. One view is, Apple was not sufficiently prudent and therefore, this was missed by Apple and its attorneys,? said Elliot Papageorgiou, a partner and executive based in Shanghai at law firm Rouse Legal (China).

?A more charitable view would be that, Apple said that for business reasons we need to use this brand and as far as the name in China is concerned, let?s cross the bridge when we come to it,? he said.

Proview lawyer Xie, partner of Grandall Law Firm?s Shenzhen office, said Apple was not currently in negotiations with the Chinese firm.

Local media reported recently that Proview was taking legal action, seeking up to 10 billion yuan ($1.6 billion) in compensation from Apple for trademark infringement.

?Without a win in that Shenzhen case, all the other actions, whether it is administrative or with different courts, customs, Apple is not in a good position at all,? said Stan Abrams, an IP law professor at Beijing?s Central University of Finance and Economics.

Whitney Houston found dead in Calif. hotel, age 48 (Reuters)

LOS ANGELES (Reuters) ? Whitney Houston, whose soaring voice lifted her to the top of the pop music world but whose personal decline was fueled by years of drug use, died on Saturday afternoon in a Beverly Hills hotel room. She was 48.

The pop superstar died on the eve of the Grammy Awards in Los Angeles at the same hotel where her mentor, record mogul Clive Davis, was holding an annual pre-event party featuring scores of music industry celebrities.

A dramatic scene unfolded at the Beverly Hilton hotel as guests arriving for the party expressed shock at her death, while reporters swarmed the hotel, fans gathered outside to light candles in her memory and helicopters hovered overhead.

Beverly Hills police said they were called to the Beverly Hilton at around 3:43 p.m. PST, and fire department personnel who were already at the location responded immediately. Houston was in her fourth-floor room but was unresponsive to CPR, and she was pronounced dead at 3:55 p.m.

"She has been positively identified by friends and family (who) were with her at the hotel, and next of kin have already been notified," Lieutenant Mark Rosen told reporters. Police said there were no obvious signs of criminal intent.

Los Angeles County coroners removed Houston's body from the hotel after midnight through a backdoor to avoid the crush of media set up to cover her shocking death.

Typically, coroners conduct an autopsy within a day or two, at which point they might release some preliminary information about the death. If drugs or alcohol are involved, however, an official cause of death would not be released until after toxicology tests, which could take six to eight weeks.

BRILLIANT CAREER

Tributes poured in from around the world for a singer whose remarkable vocal power and range produced some of the most memorable music of her generation, including her signature hit, "I Will Always Love You."

"I don't have to mask my emotion in front of a room full of so many dear friends," Davis told a somber crowd at his gala dinner and party just hours after Houston's death. "I am personally devastated by the loss of someone who has meant so much to me for so many years."

Neil Portnow, president of the Recording Academy, which runs the Grammys, told the audience at Davis's party that Jennifer Hudson would sing a tribute to Houston at Sunday night's Grammy Awards.

"We will do something appropriate tomorrow, and nothing could be more appropriate than having Jennifer Hudson sing on stage for Whitney," Portnow said. "In our community, we celebrate things ... let's celebrate Whitney Houston."

Outside the hotel in the wealthy enclave of Beverly Hills, a phalanx of hotel security personnel guarded the perimeter to prevent reporters and fans from entering. Some of Houston's admirers gathered on the sidewalk, lighting candles and singing her songs.

Over the course of a 30-year career in which she established herself as one of the most-admired and influential singers of her time, Houston won six Grammys, 30 Billboard awards and 22 American Music Awards. She released seven studio albums and sold some 170 million CDs, singles and videos. The soundtrack for a hit movie in which she starred, "The Bodyguard," was among the best-selling soundtracks in movie history.

Her 1985 debut, "Whitney Houston," became the best-selling debut album by a female act at that time, and spawned several hits including "How Will I Know." Her second studio CD, 1987's "Whitney," became the first album by a female artist to debut at No. 1 on the Billboard 200 albums chart.

She crossed over from music success to TV and movies, appearing in "The Bodyguard" (1992), as well as "Waiting to Exhale" (1995) and "The Preacher's Wife" (1996).

Born in Newark, New Jersey, in 1963, Houston was inspired to perform as a child by soul singers in her family, including mother Cissy Houston and cousins Dionne Warwick and the late Dee Dee Warwick. Her godmother was Aretha Franklin.

"I just can't talk about it now," Franklin said in a statement. "It's so stunning and unbelievable. I couldn't believe what I was reading coming across the TV screen. My heart goes out to Cissy, her daughter Bobbi Kris, her family and Bobby (Brown).".

PERSONAL TURMOIL

By the early 1990s, Houston reigned as the queen of pop, but her critical and commercial success on stage was accompanied by an increasingly troubled personal life. In 1992 she married singer Bobby Brown, who had a bad-boy reputation, and their tumultuous 14 years together were marred by drug abuse and domestic violence.

In 2000, she and Brown were stopped at an airport in Hawaii and security guards discovered marijuana in their luggage. In a 2002 TV interview, she admitted using marijuana, cocaine, alcohol and prescription drugs.

The pair also starred in a reality TV series, "Being Bobby Brown," which painted an often unflattering portrait of the couple.

The last 10 years of Houston's life were dominated by drug use, rumors of relapses and trips to rehab.

She launched a comeback tour in 2009, and in April 2010 she called media reports she was using drugs again "ridiculous." In May 2011, Houston enrolled in a drug and alcohol rehab program.

Despite her personal troubles, Houston commanded great affection among her music industry colleagues, and emotional tributes flooded the media in the hours after news broke of her death.

"I am absolutely heartbroken at the news of Whitney's passing," legendary music producer Quincy Jones said in a statement. "... I always regretted not having had the opportunity to work with her. She was a true original and a talent beyond compare. I will miss her terribly."

Barbra Streisand said in a statement: "She had everything, beauty, a magnificent voice. How sad her gifts could not bring her the same happiness they brought us."

Pop star Rihanna posted on Twitter "No words, just tears.".
